These Terms are an agreement between you and Zefesta Inc., 17015 121 NW, Edmonton, AB T5X 0H4, Alberta, Canada ("zefesta", "we", "us"). By creating an account or using the zefesta app, you agree to them. If you do not agree, do not use zefesta.
1. What zefesta is
zefesta is a marketplace for event services. Customers plan an event, choose services such as venues, photography, music, decor, catering and cakes, and send booking requests. Vendors decide whether to accept each request.
zefesta is not the vendor. The service at your event is provided by the vendor, under an agreement between the customer and that vendor. We provide the app, pass requests and messages between you, record payments, and help when something goes wrong.
2. Your account
- You must be at least 18.
- Give accurate information and keep it up to date, including a phone number where you can be reached.
- Keep your sign-in details private. You are responsible for what happens in your account.
- One person or business per account. Vendor accounts are reviewed by our team before their listings go live.
3. For customers
zefesta is free for customers. We charge no booking fee and no service fee. You pay only the vendors' prices.
Planning and sending. You can add services to an event with or without a date. The price of each service is held as shown when you add it. When you send your event, each service becomes a separate request to its vendor.
Availability is never guaranteed until confirmed. "Available" in the app means the vendor has not blocked that date. A vendor may still decline, and accepting a request does not reserve your date.
Your date is reserved when your deposit is received. After a vendor accepts, you pay a deposit for that service (40% of its price, due within 7 days). Until we have received the full deposit, other customers can still book that service for the same date, and the first full deposit received gets the date. If someone else's deposit is received first, your booking for that service is cancelled and anything you paid toward it is refunded.
Paying the rest. The balance for each service is due 14 days before your event. If your event is sooner than that, the full amount is due within 2 days of the vendor accepting. The app shows each amount and due date.
How you pay. For now, payments are made directly to zefesta by the methods our team gives you (for example e-transfer), and our team records them. You receive a receipt by email for every payment. Prices include applicable taxes unless a listing says otherwise.
If you do not pay on time. We may extend a due date or cancel the booking. A booking without a paid deposit can be cancelled without notice once the deposit is overdue.
4. For vendors
- Your listing must be accurate: services, packages, prices, photos, service area and availability. Use only photos and content you have the right to use.
- Keep your calendar current. Block dates you cannot take. A confirmed booking holds that service's date; other services you offer stay bookable unless you block the day.
- Answer requests promptly. We send reminders for requests left waiting.
- Honour the price. The price the customer was shown when they added your service is the price for that booking, even if you change your listing later.
- Honour confirmed bookings. Once a booking is confirmed (the deposit is received) you may not cancel it yourself. You ask us, with an explanation, and we decide. Repeated or unjustified cancellations can lead to your account being paused, suspended or removed.
- You are responsible for your service: its quality, your staff, permits, licences, insurance and taxes.
- Payment to you. We pass on the amounts customers pay for your bookings, less our fee of 8%, on the schedule we agree with you.
5. Messages and contact details
Customers and vendors can message each other in the app about a request. Phone numbers and email addresses are shared between a customer and a vendor only once the booking is confirmed. Do not use messages to send spam, to harass anyone, or to arrange payment outside zefesta for a booking made through zefesta.
6. Rules for everyone
You agree not to:
- give false information or pretend to be someone else;
- post content that is illegal, misleading, offensive, or that you have no right to use;
- book or accept bookings you do not intend to honour;
- take a booking that started on zefesta outside the app in order to avoid these Terms;
- interfere with the app, try to access other people's information, or copy our content or listings in bulk.
7. Cancellations and refunds
Before the deposit is paid. A customer can remove a service from a sent event any time before the vendor accepts it. A vendor can cancel an accepted booking that is not yet confirmed, with a note for the customer. No money is owed either way.
After the booking is confirmed. Either side asks to cancel in the app and must explain what happened. The booking stays confirmed until our team decides. Your explanation is read only by our team; it is not passed to the other side.
If the customer cancels a confirmed booking:
| When | Refund |
|---|---|
| More than 60 days before the event | Everything paid, less an admin fee of $100 |
| 30 to 60 days before the event | Everything paid except the deposit |
| Fewer than 30 days before the event | No refund |
If the vendor cancels a confirmed booking, or cannot deliver the service, the customer gets a full refund of everything paid for that service.
If zefesta cancels a booking (for example because a deposit was not received, or an account broke these Terms), we tell both sides. Amounts paid are refunded according to the rules above, depending on the reason.
How refunds are paid. Refunds are sent by the method you paid with where possible, within 10 business days of the decision. You receive a refund receipt by email.
Events outside anyone's control. If an event cannot go ahead because of something neither side could prevent (for example a natural disaster or a government order), we will work with both sides on a fair result, which may be a new date or a refund.
8. Disputes between customers and vendors
If something goes wrong with a booking, tell us at support@zefesta.com within 14 days of the event. We will look at what both sides say and may propose a solution, including a refund from money we still hold. We are not required to settle disputes, and our decision does not remove any rights you have against the other party.
9. Pausing, suspending or closing accounts
We may pause, suspend or close an account that breaks these Terms, puts others at risk, or misuses the service. A paused account can browse but cannot send new requests. We will tell you when your account is restricted. Confirmed upcoming bookings are not cancelled automatically when an account is restricted; our team handles them case by case.
You can delete your account at any time in the app under Profile → Delete account. Open and upcoming bookings are then cancelled and the other side is told; refunds follow section 7. See Delete your zefesta account.
10. Your content, and ours
You keep ownership of what you upload (photos, descriptions, messages). You give zefesta permission to store, display and share it as needed to run the service, for example showing a vendor's photos to customers. The zefesta name, logo, app and design belong to us and may not be used without our permission.
11. Our responsibility
- We do not provide the event services, and we do not guarantee any vendor's work, any customer's conduct, or that a listing is free of errors.
- We provide the app "as is". We work to keep it available and correct but do not promise it will never be interrupted or contain mistakes.
- To the extent the law allows, zefesta is not liable for indirect or consequential losses, and our total liability for a booking is limited to the amount paid to zefesta for that booking.
- Nothing in these Terms removes rights that the law does not allow to be removed, including consumer protection rights in your province.
12. Privacy
Our Privacy Policy explains what information we collect and how we use it.
13. Changes to these Terms
We may update these Terms. If a change is important, we will tell you in the app or by email before it takes effect, and we may ask you to agree again. A booking stays under the version of the Terms that applied when it was sent.
14. Law
These Terms are governed by the laws of Alberta and the laws of Canada that apply there. Disputes go to the courts of Alberta, unless consumer protection law gives you the right to bring a claim where you live.
